VINCENNES, IN–(Marketwired – October 24, 2016) – On September 30, 2016, the Superior Court of Knox County, Indiana entered judgment in favor of Vincennes residents, Roy and Sarah Blair, and against FCA US LLC for violation of the Indiana Lemon Law. The case involved a 2015 Jeep Wrangler that Mr. and Mrs. Blair purchased new on October 11, 2014. Less than 2 weeks after their purchase, the cruise control in the Jeep stopped working and water started to leak into the vehicle from the doors. As a result, the Blairs returned their lemon vehicle for repair multiple times to no avail.
After providing FCA through its Jeep dealers with at least 9 times to repair the defects in the vehicle, the Blairs finally had enough and hired lemon law attorneys, Krohn & Moss, Ltd. On January 4, 2016, the Blairs attorneys sent notice to FCA advising the automobile manufacturer of their intent to pursue lemon law claims if an amicable resolution could not be reached. Unfortunately, FCA did not respond and suit was filed on January 29, 2016.
On February 29, 2016, FCA served the Blairs with its Answer to their legal Complaint that denied the Blairs’ allegations. For the next 7 months, litigation continued until FCA served the Blairs with an Offer of Judgment that provided them with a credit in the amount of $37,570 towards the purchase of another FCA vehicle. The Blairs accepted FCA’s Offer of Judgment. As the prevailing parties in this matter, the Blairs will now seek their attorneys’ fees and costs from FCA, which are recoverable per Indiana and federal law.
