The New Jersey lemon law was established to help protect drivers from inherently defunct vehicles. This ensures that if you buy a vehicle that is a lemon, you won’t be stuck with a vehicle that has many problems. The defect must persist after three attempts to repair it and the vehicle also must be out of service for a cumulative of 20 days during the first two years of ownership or 24,000 miles, whichever occurs first.

If your vehicle meets the above criteria, the manufacturer is responsible for repairing the defects under the original warranty. Issues must be reported promptly in order to be covered. Please keep in mind that the New Jersey lemon law does not protect defects to your vehicle that were caused by an accident, vandalism, abuse or neglect. If any repairs are completed, they must be done by the manufacturer, its agent or an authorized dealer. Keep Records & Send a Letter It’s important that you keep records of all repair attempts as well as document your interactions with both the manufacturer and the dealer. You’ll also need to look at the manufacturer’s warranty to see what repairs it covers.

From there, the next step in filing your vehicle as a lemon is completing a letter and application and sending it to the Division of Consumer Affairs’ Lemon Law Unit. From there, the manufacturer has 10 days in order to make the repairs. If this does not happen, you have the rights to demand a full refund of your vehicle’s purchase price.
